Illinois Notary Public Act Rule Amended for Performing Services

Established in 1977, Codilis & Associates, based in Burr Ridge, Illinois, represents clients in real estate cases. At Codilis and Associates, the attorneys are also involved with professional memberships such as the Illinois State Bar Association (ISBN), a voluntary organization comprised of over 28,000 members.

In a July 2023 ISBN press release, the organization announced that Governor Pritzker signed amendments to the Illinois Notary Public Act, including how notaries perform their services. Once commissioned, notaries can perform services in three ways.

In addition to in-person services, notaries can now perform notary services remotely, but the notary must be in Illinois when the services are rendered. Furthermore, the notary must indicate the services were rendered through communication technology.

Finally, it established rules for electronic notarial acts, which involve verifying the identity of the person signing the documents through an assessment. Then, a credential analysis is used to verify government-issued identification. The notary must view the information to make sure everything matches. This amendment was a part of various rules, including changes to record-keeping and rules governing becoming a notary or recertification. For more information, please visit www.isba.org.
